CARLO Alfred Tenorio Borja has admitted to one charge of a sex crime against a minor while numerous other charges against him will be tossed out.
The 32-year-old pled guilty yesterday in the Superior Court of Guam to felony first degree criminal sexual conduct. In six court cases, Borja faced a total of 27 charges against him, but as part of a plea agreement, Borja only admitted to one offense, while prosecution agreed to dismiss the remaining charges.
Borja’s alleged crimes occurred between July 2005 and February 2006, according to court documents. Of the numerous offenses, Borja was accused of rape, kidnapping, terrorizing, child abuse, assault, harassment, and indecent exposure.
Borja admitted to a sex crime that occurred on Oct. 12, 2005 against a 9-year-old girl.
During the change of plea hearing yesterday, Judge Anita Sukola advised Borja that by signing the plea agreement, the case won’t go to trial. Borja acknowledged this, in addition to waiving many other rights, including the right to an appeal.
Borja will be required to register as a sex offender. According to Sukola, Borja should be classified as a level one sex offender, which means he will remain on the registry for life.
Sentence
The plea agreement states Borja shall be sentenced to 15 years imprisonment at the Department of Corrections, with credit for time served. Borja has already served six years and still remains incarcerated.
Upon release, the agreement further stated Borja shall be placed on supervised parole for five years with a number of conditions including that he have absolutely no direct or indirect contact with any of the victims.
However, because Borja is a Philippine immigrant, he may be deported before he even gets on parole. According to defense attorney Howard Trapp, DOC would turn over Borja to immigration authorities once he’s completed his time at DOC.
Borja’s sentencing is set for 2 p.m. on Sept. 6 before Judge Sukola.
