Judge orders police to submit seized evidence

DISTRICT Court of Guam Chief Judge Frances Tydingco-Gatewood on Wednesday ordered the Guam Police Department to make evidence in its possession available to the prosecutor and defense counsel in the case against Jeremiah Santos Isezaki.

During a pre-trial conference earlier this week, both counsels told Tydingco-Gatewood they were unable to review certain evidence held by GPD's evidence section.

As a result, it was ordered that GPD make the seized properties available for inspection no later than today. It was further ordered that GPD bring the seized properties to the District Court on June 12 at 9:30 a.m., which is scheduled as the jury selection and trial for Isezaki’s case.

Isezaki was indicted in federal court with felon in possession of a firearm. According to the federal indictment, prior to the alleged possession of a firearm, Isezaki was convicted in local court with aggravated assault in December 1998; and theft of a motor vehicle and aggravated assault in September 2001.

The federal charges stem from an incident that occurred late January, when Isezaki allegedly led police on a high-speed chase then crashed into the jungle.

Police found Isezaki lying in the jungle with a backpack on him containing a Colt .45 pistol wrapped in a blue towel as well as a 2-inch straw with methamphetamine residue.

According to local court documents, he acknowledged the backpack was his. However, he did not possess a firearms ID card.

Isezaki also has another case in local court in which he has pleaded not guilty to conspiracy to commit murder and terrorizing. Subsequent to his arrest in January, Isezaki and co-defendant Brandon John Baluran allegedly asked a 17-year-old girl to lure Officer Benny Babauta to an undisclosed location with the alleged intent of killing him.

Sounds like a nice guy. We have lots like him in Guam.
