A MOTHER in far away Kentucky got a nice Mother’s Day present this past weekend, thanks to an unusual agreement worked out between her son's defense attorney and the Attorney General’s Office, and accepted by the Superior Court.
Defendant Derek Keith Weise was charged with terrorizing and family violence in connection with incidents occurring in June of last year. His attorney, Howard Trapp, worked out an agreement allowing Weise to plead “nolo contendere” to a charge of terrorizing as a third degree felony, and two counts of assault and family violence as misdemeanors, provided the defendant secure a one-way ticket, at his expense, from Guam to his home state of Kentucky. Other charges stemming from the incidents were dropped as part of the plea agreement.
His sentence was reduced to time served plus a fine of $400, plus restitution, if any, to be determined by the court. Assistant Attorney General Elizabeth Vasiliades entered into the plea agreement on behalf of the people of Guam, and Judge Michael J. Bordallo agreed to the 11-page document.
Weise was released from the Department of Corrections to a third-party custodian early Friday morning, May 11, and boarded a flight home that same morning. He arrived back at his Kentucky home in time for Mother’s Day. He must comply with all terms and conditions of the agreement, including reporting to appropriate authorities in Kentucky. It is not clear from the plea agreement whether Weise can ever return to Guam, should he ever want to.
