Marshal wants indictment dismissed

JUDICIARY of Guam Deputy Marshal III Michelle Therese Ungacta, who was indicted on charges of allegedly stalking her ex-boyfriend’s former girlfriend, is asking the Superior Court to dismiss the charges.

In a May 3 court document filed by Ungacta’s defense attorney Randy Cunliffe, it was asked that the prosecutors “provide some specificity as to what it is she is accused of having done.”

The court documents further stated “there is not one fact alleging what Ungacta supposedly did in any of the various charges against her.” Guam law requires that essential facts are provided, constituting the offense charged.

Ungacta pleaded not guilty to charges of simple stalking, harassment, obstruction of government function, and official misconduct.

According to Variety news files, the victim filed the complaint against Ungacta in December of last year because she was in fear of her safety and was intimidated.

Ungacta allegedly followed the victim, called her, showed up at her workplace, and would follow her home, court documents state.
